The reasonswhy constitutional rights changed 1. The change of leadership Firstly, the changes of constitutional rights were inseparable with thoughts of Chinese leaders. The Constitution of 1954 and the Constitution of 1975 were legis- lated and amended under the supervision of leaderMao, the contents of them appar- ently represented the change of leaderMao’s thought. In 2004, the principle of "The state respects and protects human rights" was established and it also showed the change of leaders. Secondly, the right awareness of Chinese people was gradually awakening, Chinese people increasingly valued the importance of using law to pro- tect their own rights. It was also one of the most important reasons that stimulating theChinese constitutionmake progress. 2. The transformationof the economic system As China gradually changed from planned economy tomarket economy, peo- ple prefer to use legal means to protect personal rights. Market economy should be run under a relatively comprehensive legal framework. In other words, law should governmarket economy. Law coordinates the participants of market economy. That meanswhen there are conflicts among participants, we should use a uniform standard to resolve contradictions to maintain stability of the market. Thus the core of the market economy is protecting constitutional rights. 3. Influences ofworld trend AfterWorldWar II, China conformed to the trend of people-oriented philoso- phy of the world, so during the amendments since Chinese new government estab- lished in 1949, the basic right partmainly consulted the "Conventionon theElimina- tion of All Forms of Racial Discrimination", " Convention against Torture ", " The Convention on the Elimination of All Forms of Discrimination againstWomen " and " rights of the Child protection Convention".
